The redevelopment of the site for a terrace of four luxury homes near the Coombe Estate was granted at appeal.

What we did

  • Involvement during the planning application’s determination period to provide rebuttal to Planning Officer concerns.

  • Advised the client on their right to appeal the council’s decision to refuse the application. This included instructing Leading Counsel to discuss the proposals, reasons for refusal and a strategy moving forward. This strategy included the submission of an application for two dwellings, which was approved by Kingston Council at Officer level, establishing the principle of subdivision.

  • The main reason for refusal focussed solely on subjective grounds relating to design, its impact on the character of the area and over-development, as such we set out to ensure our appeal statement and documentation was as factual and empirical as possible, disputing the 

  • Council’s, unsupported rationale. This included commissioning an independent townscape analysis to define the character of the area.

  • Supported our Appeal submission with recent planning and appeal decisions for sites of a similar nature within comparable contexts within the Borough as helpful precedents.

  • Ensured we were fully up to speed with the proposals for the planning application, the application documentation and correspondence that occurred before our involvement.

  • Given the subjective nature of the main reason for refusal there was a risk that the Inspector may have agreed with the Council’s restricted view of the character and context of the Appeal site. Our strategy to justify the appeal proposals in a factual and empirical method was key to demonstrating to the Inspector the proposals were acceptable in design and character terms.

 

Result

  • We secured planning permission, at appeal, for the redevelopment of an existing residential plot for four luxury family homes near the Coombe Estate.

  • In addition to the four home scheme, planning permission was also secured for two large detached family homes as a fallback option.

  • The client was pleased with the decisive strategy we implemented to ensure the Appeal submission was comprehensive and technically robust.

  • The client was impressed with our recommendations and our project management of the preparation and submission of the Appeal.

  • A quick decision from the Inspectorate means the client is able to sell the site quickly, minimising holding costs.
