Dilapidations relate to remedial works required to a rented property and can be defined as items of property in disrepair and breaches of covenant to repair a building contained in a lease or sub-lease.
The Building Surveying teams' experience has highlighted that tenants often consider dilapidations as insignificant in comparison with the rent rates and service charge when seeking new premises. However, the liability to repair can have significant financial implications and should be considered carefully to mitigate the liability over a number of years.
Tenants should therefore seek the advice of a Chartered Surveyor to limit or avoid a dilapidations claim before entering into a lease or when a Schedule of Dilapidations has been served upon them.
